In exercise of the powers conferred by section 18 of the Foreign Exchange Management Act (FEMA), 1999, the Central Government has constituted Appellate Tribunal for Foreign Exchange (ATFE) to hear appeals against the orders passed by the Adjudicating Authorities and the Special Director (Appeals) under this Act. The office of the ATFE is located at 15th Floor, the Hindustan Times House, K.G. Marg, New Delhi.
Section 20 of the FEMA, Act, 1999, states that the ATFE shall consist of a Chairperson and such number of Members as the Central Government may deem fit. At present, there is one Chairperson and two full time Members in the Tribunal. The service conditions of the Chairperson and Members of the ATFE are administered by the “Appellate Tribunal for Foreign Exchange (Recruitment, Salary and Allowances and Other Conditions of Service of Chairperson and Members) Rules, 2000”.
